REGULATION ON THE ORGANIZATION AND FUNCTIONING OF THE OFFICE OF THE PRESIDENT OF CAHUL DISTRICT

I. General Provisions

The Regulation on the organization and functioning of the Office of the President of Cahul District (hereinafter referred to as "the Regulation") governs the mission, main functions, duties, and rights of the Office of the President of Cahul District (hereinafter referred to as "the Office"), as well as the procedure for its organization and operation.

The Office is a functional structure that provides support to the President of the District in fulfilling his legal duties and operates under the leadership of the District President.

The Office is organized and functions based on the Constitution of the Republic of Moldova, Law No. 436-XVI of December 28, 2006 on Local Public Administration, Law No. 435-XVI of December 28, 2006 on Administrative Decentralization, Law No. 158-XVI of July 4, 2008 on Public Function and Status of Civil Servants, Law No. 768-XIV of February 2, 2000 on the Status of the Local Elected Official, the Law on the Code of Conduct for Civil Servants No. 25 of February 22, 2008, Law No. 155 of July 21, 2011 on the Approval of the Unified Classifier of Public Positions, as well as other legislative acts, government decisions, orders and resolutions, decisions of the Cahul District Council, and this Regulation.

The Office organizes its activities in accordance with the principles of transparency in decision-making and personal responsibility of its managers for the decisions made within their competencies.

The Office of the President is located in the city of Cahul, Independence Square, No. 2.


II. Organizational Structure of the Office of the President of Cahul District

The organizational structure, staffing chart, and Regulation on the organization and functioning of the Office of the President are approved by the Cahul District Council upon the proposal of the President.

Structurally, the Office of the President consists of the district leadership, the Secretary of the District Council, directorates, departments, and other subdivisions.

The structural subdivisions of the President’s Office operate based on their own regulations approved by the President of the District.

The staff of the Office includes civil servants and contract employees. The labor relations of civil servants are regulated by Law No. 158-XVI of July 4, 2008 on Public Function and Status of Civil Servants, while the labor relations of contract staff are regulated by the Labor Code of the Republic of Moldova No. 154-XV of March 28, 2003.

The President of the District appoints to public positions, modifies, suspends, and terminates the service relations of civil servants in accordance with the law. He also concludes and terminates individual labor contracts with non-civil servant staff, manages personnel, and determines their duties.

The President takes measures and is responsible for the training and professional development of the Office’s staff.

In performing their duties, the subdivisions of the Office cooperate with local government authorities, decentralized services of ministries and other central authorities operating in the district, as well as with the management of institutions and services under the authority of the District Council.

The structural subdivisions carry out their functions in accordance with this Regulation, internal regulations, instructions from the President, Vice Presidents, or Secretary of the District Council, in accordance with their competence.

Heads of directorates, departments, and other structural units are responsible for organizing their activities, defining the job duties of subordinate staff, proposing incentive measures or, if necessary and within their competence, applying disciplinary measures, as well as fulfilling other tasks stipulated by internal acts and/or the President's instructions.

The staff of the Office is legally responsible for the preservation and confidentiality of the documents handled.


III. Mission and Responsibilities of the President’s Office

The mission of the Office is:

  • To ensure organizational and informational support for the activities of the District President in fulfilling his duties as prescribed by law, by providing stable, professional, transparent, efficient, and impartial public services in the interest of citizens as well as local authorities and institutions.

The responsibilities of the Office’s staff are organized based on the different types of functions performed, as follows:

  • Activities in the field of public administration and secretariat;

  • Administrative and financial activities;

  • Public relations;

  • Archival work;

  • Urban planning and territorial development;

  • Legal services;

  • Human resources management;

  • Internal public audit;

  • Civil protection and public service activities.

As a functional structure, the Office performs the following tasks as outlined in Law No. 436-XVI of December 28, 2006 "On Local Public Administration":

  • Drafting decisions of the District Council and orders of the District President;

  • Organizing public consultations on draft Council decisions and normative orders of the President, as well as informing the public about adopted decisions and issued orders;

  • Gathering and presenting to the President information for the annual report on the socio-economic situation of the district;

  • Assisting the President in fulfilling duties related to the implementation of gender equality legislation;

  • Together with public services, presenting information to the President about the functioning of those services and enterprises created by the District Council;

  • Monitoring the implementation of measures ordered by the President within the district’s jurisdiction;

  • Preparing the draft budget of the administrative-territorial unit for the following fiscal year and proposed amendments to the budget for the President’s submission to the Council;

  • Ensuring the execution of the budget in accordance with the decisions of the Council and legal regulations;

  • Preparing the budget execution report of the administrative-territorial unit;

  • Assisting the Secretary of the District Council in fulfilling his/her duties according to the law.

The Office of the President may also perform other tasks as provided by current legislation or necessary for the full and timely execution of its functions.
